Yes, that is the most recent software the 1st gen iPod touch is compatible with. If you already have it your set but if not will have to purchase the 3.1 software from iTunes.

It is free for iPhones but iPod touch models you have to pay to do major upgrades such as going from ios 3 to iOS 4. The upgrades in between such as 3.1, 3.2 are free. In this case ios 3.1 costs $4.99 from itunes. You can find it free online but not from apple. Not sure the reasoning behind this except that apple makes more money from iPhones over time than they do from iPods. Also it sounds like they are giving the iPad 1 free major update (iOS 5) so I imagine when 6 comes out it will be $10 to upgrade.
