So it is OK to jail break even though Apple does not allow it, but it is not OK to talk about Installous or xSellize. We can't talk about pirated apps but cydia itself is a pirated app to Apple. I know that police officer Marilyn (Mikey330) is immediately going to shut this post down but there does seem to be a double standard here. Where is the free speech?

First of, you need to understand the what is LEGAL under the law.

1) Jailbreaking is LEGAL under the DMCA (Digital Millennium Copyright Act) on file with the Library of Congress.

This means Apple and the cellular service provider can claim the user has broken their ToS (Terms of Service) but they can NOT prosecute you in anyway. All they can do is refuse you service if they are so inclined.

2) Cydia is NOT illegal in any way, shape or form under any laws.

Apple can cry foul but that is about it. Until Cydia breaks a law by using code that is copyrighted or patented by Apple, there is nothing illegal about it.

3) Installous and xSellize allow the user to BREAK the laws current on file.

They allow users to install apps that have DRM (Digital Rights Management) in place. This is AGAINST the law under the DMCA.



Hopefully this clears things up for you. I am a professional developer (for the last 28 years) and I have to stay on top of this very touchy subject every single day.

Skull is exactly right. THere are a ton of legitimate uses with Cydia and Jailbreaking. However, we do NOT CONDONE piracy -- support the people that write the apps. You paid for your phone, you should be able to use it however you want... thus we support Cydia and Jailbreaking. However, this does not mean you can pirate software -- read: it's stealing.

We draw the line there. It's pretty easy if you think about it.
