Ok so with the SMS app it overrides the custom tones for everyone with the default tone, I've tried everything doesn't change, and I'm not new to iPhone, thanks any help would be appreciated.

Ok try Ringtone Designer as it creates ringtones as well as your very own text tones, I am also a iPhone 4S owner, it is the best app going & comes with a introduction video, I hope this helps you out?

Actually it wasn't that it was the iCloud contacts downloaded to my phone were overriding the contacts I already have on my phone, so once I separated the ones I need from the ones I didn't the custom ring tones work.
