sound / silent button help

Hi i have an iphone 4s and had to get a new phone from apple store before christmas due to wifi issues. However in the last few days when i have been typing a message it has come up that it has switched from silent to loud, then back to silent all within a few seconds but i am no where near the button. I pretty much always have my phone on silent, so i have no real need to touch that button.
Was just wondering if anyone else has had this problem.

My particular field of expertise is iOS Jailbreaking and Unlocking.

Might want to perform a fresh restore on it first (unless it's on iOS 5 and you want to jailbreak it). I recommend restoring new devices to ensure that everything's clean.

Try a fresh restore as a New Device first, as willerz stated above. If that doesn't resolve the issue... you're probably looking @ a hardware issue and you may have to exercise your warranty.
