Follow this tutorial to downgrade your iPhone 3GS to iOS 4.1. This will allow you to perform an untethered jailbreak.
1) Download redsn0w.
2) Download the iOS 4.1 IPSW from herehttp://m.iclarified.com/entry/index.php?enid=750 and save it to your desktop.
3) Connect your iPhone to your Mac/PC
4) Launch redsn0w. You don't need iTunes yet.
5) Click "Extras" and then "Restore".
6) Click "IPSW" and choose the one you downloaded earlier. Use remote blobs for this restore.
7) When asked if you'd like to preserve the baseband, click "No" if you don't know what it means.
8) Follow on-screen instructions to put your device into DFU mode.
9) Waits until restore has finished.
10) Open iTunes to activate your iPhone, and you're done.
If you want to jailbreak, use redsn0w, and if your phone can't be activated, you should also jailbreak with redsn0w.
