Can I transfer info from my IPad3 with ios6 to iPhone 5S without upgrading IPad to ios7?

You won't have to restore the iOS on either devices. As long as the iPhone's iOS is the same or above that of the iPad (which is the case in your scenario, you can simply restore the backup)
