Is it illegal to sell the jailbreaks? I mean if not why wouldn't the guy who has already JB the ipad3 on the newest update release it for a fee, since it seems he will not release anything free?

No, it is not illegal to sell a jailbreak. i0n1c won't release it for free because he sells his work to companies and security specialists and by releasing his work for free he loses money. If he charged money for it, it would only be a matter of minutes before it was reuploaded free of charge all over the internet so it would be pointless to charge for it. Even if he did charge for it, he could never charge enough to make as much money as he does selling it to other companies.
5.1.1 can still be jailbroken tethered (non a5)
A4 and lower devices are jailbroken tethered for life. All future firmwares will be jailbreakable tethered as well.
